Seven Vietnamese Get $23,300 Compensation for Justice Miscarriage in Murder Case

A group of seven Vietnamese in the Mekong Delta province of Soc Trang have been compensated with VND500 million ($23,000) from the provincial People’s Procuracy for judicial miscarriage in a local murder case, state media reported.
On Jan 14, Tran Van Do, Khau Soc, Tran Hol, Thach So Phach, Thach Muoi, Tran Cua and Nguyen Thi Be Diem of the group received compensation of between VND66 and VND74 million for detention and torture by police investigators during interrogation, the VnExpress.net website reported.
The group was arrested in 2013 on allegation of killing Ly Van Dung in Dai An 2 commune in Tran De district who was found murdered on July 6.
When the local police nearly completed investigation to bring the 7 suspected to court, Le Thi My Duyen and Phan Thi Kim Xuyen came to police confess that they were the real murders of Dung for his property.
The seven-member group was released while 25 police officers and policemen in Soc Trang province got disciplined with different levels. Captain Trieu Tuan Hung and major Nguyen Hoang Quan were investigated for conducting torture.
The members of the group are the first people receiving compensation for judicial miscarriage and police torture in Vietnam where police torture is systematic and miscarriage of justice has been found in many cases.
In early 2014, Nguyen Thanh Chan in the northern province of Bac Giang was released after ten years in prison for wrong accusation of killing one local resident. He demanded a compensation of VND10 billion ($500,000) for the wrongful sentence and police torture after the real murder in the case confessed his crime.
Meanwhile, Ho Duy Hai in Long An and Nguyen Van Chuong in Haiphong have complained that they were tortured and tried unfairly in murder cases. Both were sentenced with the capital punishment and their planned executions in December last year were suspended by President Truong Tan Sang for further review.
Last week, the Standing Committee of Vietnam’s National Assembly asked the Supreme People’s Procuracy to cooperate with other state agencies to review 16 death-sentenced cases suspected of legal miscarriage.
Among the cases are death sentences of Han Duc Long and Do Thi Hang in Bac Giang, Ho Duy Hai in Long An, Nguyen Van Chuong in Haiphong, Huynh Van Nen in Binh Thuan and Le Ba Mai in Binh Phuoc. These cases have attracted a great deal of public attention.
According to state media, in these cases, the people who received the capital punishment have complained of being tortured during the police interrogation and tried unfairly.

In the communist-ruled Vietnam where the communist party controls all legislation, executive and justice, the police’s systematic torture and unfair trials are main causes for miscarriage of justice, said Hanoi-based analysts.
